Terms and Conditions
eStatement Service Terms and Conditions Standard Chartered Bank, Jakarta Branch, having its address at Menara Standard Chartered Bank, Jalan Prof. Dr. Satrio no.164 Jakarta 12930 (“the Bank”), intends to offer to the holder of credit cards issued by the Bank (“the Customer”) the service of receiving the Customer’s monthly credit card statement by electronic mail (“the email statement”). The provision of this service (“the eStatement service”) is subject to the following Terms and Conditions: 1. Application for the eStatement service a) The Customer may apply for the eStatement service by telephone through the Bank’s Call Center or by submitting to the Bank an online application form found at www.standardchartered.co.id. Customer may be required to physically deliver to the Bank all necessary supporting information and/or documents as may be specified by the Bank. The Bank takes no responsibility for the consequences of any incomplete information and/or documents furnished by the Customer. In the event of any changes in the information provided, the Customer will promptly notify the Bank. b) Upon the Bank receiving and approving the Customer’s application for the eStatement service, the Bank will send a notification email to the Customer containing a system-generated Password for the purpose of opening and viewing the email statement The Customer is entirely responsible for ensuring that the Password is kept confidential without disclosure to any third party. The Bank accepts no responsibility for the consequences of the Customer failing to keep the Password confidential. c) By applying for the eStatement service in the manner prescribed by the Bank, the Customer warrant and represent to the Bank that the Customer has the right and capacity to enter into this agreement and all information and/or documents furnished by the Customer to the Bank are correct and accurate and that further the Customer accepts the Terms and Conditions of this Agreement. d) The Bank has the absolute right to approve or reject the Customer’s application for the eStatement service without providing an explanation to the Customer if the application for the eStatement service is rejected. e) The Customer cannot change the system-generated Password given by The Bank and therefore has to be entirely responsible in keeping the password confidential. f) The Bank may cancel the use of the eStatement service by the Customer at anytime without notice or reason to the Customer. Should the Bank decide to cancel the use of the eStatement service it may revert to send the monthly credit card statement to the Customer by post or in such manner as the Bank may select. g) Upon receiving the Customer’s application, the Bank will verify the application with the Customer by whatever means deemed appropriate by the Bank. h) The Bank reserves the right not to send the monthly credit card statement by post to the Customer who has decided to receive the email Statement by electronic mail. 2. Delivery of email Statement a) The email Statement will be sent by the Bank using electronic mail to the electronic mail address provided by the Customer on a monthly or other periodic basis as the Bank may deem fit. b) Upon receiving the electronic mail from the Bank notifying the availability of the email statement, the Customer may use the Password to open and view the email Statement. The email Statement will be in text/graphic pdf format, which will be encrypted with the Password. 3. Maintenance of equipment and electronic mail account a) The Customer will ensure that the Customer’s computer or other equipment which the Customer uses to access the eStatement service is maintained properly and free from viruses and/or any software or programs which may cause damage to Customer’s computer and/or to the computer system maintained by the Bank. b) The Customer will provide the Bank with the Customer’s electronic mail address to enable the Bank to send the email Statement by electronic mail to the Customer. It is the Customer’s sole responsibility to ensure that the electronic mail address is functional. c) The Customer will be responsible for installing the appropriate computer software such as Acrobat Reader on the Customer’s computer, which is required to view the email Statement. 4. Breach If the Customer breaches any term of this Agreement, the Customer undertakes to compensate the Bank for any direct, indirect or consequential loss and/or damage whether foreseeable or not suffered by the Bank. 5. Fees and charges The Bank reserves the right to levy a eStatement service charge on the Customer for the provision of the eStatement service by posting notice of such fees and charges in a reasonable means of notification, and the Customer shall be bound immediately upon such posting or notification. The amount of the eStatement service charge may be determined by the Bank in its absolute discretion. 6. Termination Subject to the Bank’s right to terminate the eStatement service, the Bank will terminate the eStatement service if the electronic mail address provided by the Customer is invalid or upon request by the Customer. This Terms and Conditions shall continue in effect for a period of 24 months (or as long as the Customer is a cardholder of the issuing Bank). With regard of the Terms and Conditions termination, the Customer and the Bank hereby agree to waive and set aside the provision of Articles 1266 and 1267 of the Indonesian Civil Code. 7. Limitation of Liability and indemnity a) Where permitted by the Law, the Bank will not be liable for any loss, damage or injury in whatsoever manner directly or indirectly suffered by the Customer or any third party whatsoever and howsoever occasioned including but not limited to the following loss: (i) Where the Bank is complying with any instruction given or purported to be given by the Customer. (ii) Where the Customer is unable to utilize the eStatement service as a result of any action taken by the Bank or due to the Bank or the internet eStatement service provider carrying out system maintenance or the breakdown or unavailability of any network. b) The Customer will indemnify the Bank against any liability, loss, damage, including all legal fees, which may be incurred by the Bank as a result of providing the eStatement service to the Customer or as a result of having to enforce the Bank 's rights under this agreement. 8. Amendment of Agreement The Bank may amend, add to, or delete any provision of these Terms and Conditions at its sole discretion, by posting notice of such changes in a reasonable means of notification, and the Customer shall be bound by such changes immediately upon such posting or notification. If any such change is unacceptable, the Customer shall promptly discontinue the eStatement service. Continuing with the eStatement service after posting or notification of any such change shall be deemed to be agreed to such change in relation to the eStatement service. 9. Miscellaneous a) The Terms and Conditions are over and above the agreements between the Customer and the Bank in respect of the usage of the credit cards issued by the Bank. b) The Customer means the principal credit card member and does not include or apply to the supplementary credit card member. c) The Bank may (but is not obliged to) send its promotional materials or brochures to the Customer using the electronic mail to the electronic mail address provided by the Customer. 10. Choice of governing law This Agreement shall be governed and construed under the laws of Republic of Indonesia and for the implementation of this Agreement and all its consequences, the Customer and the Bank hereby select and choose general and permanent domicile at the Clerk’s Office of the District Court of Jakarta Selatan. Syarat dan Ketentuan Layanan eStatement Standard Chartered Bank, Kantor Cabang Jakarta, beralamat di Menara Standard Chartered Bank, Jalan Prof. Dr. Satrio No. 164 Jakarta 12930 (selanjutnya disebut “Bank”) menawarkan layanan yang memungkinkan pemegang Kartu Kredit Visa dan/atau Master yang diterbitkan oleh Bank (selanjutnya disebut “Nasabah”) untuk menerima laporan tagihan bulanan melalui electronic mail (selanjutnya disebut “email statement”). Penggunaan Layanan ini (selanjutnya disebut “layanan eStatement”) diatur berdasarkan Syarat dan Ketentuan sebagai berikut: 1. Pendaftaran layanan eStatement a) Nasabah dapat mendaftar untuk mendapatkan layanan eStatement dengan cara menghubungi layanan Call Centre Bank atau dengan melengkapi formulir aplikasi online di www.standardchartered.co.id. Bilamana diperlukan, Nasabah akan diminta untuk mengirim data atau informasi dan/atau dokumen pendukung yang ditentukan oleh Bank. Dalam hal Nasabah tidak dapat melengkapi informasi dan/atau dokumen yang diperlukan, maka Bank tidak bertanggung jawab untuk menyediakan layanan eStatement termaksud. Jika terjadi perubahan informasi yang telah diberikan oleh Nasabah kepada Bank, maka Nasabah wajib melakukan pemberitahuan secara tertulis kepada Bank. b) Setelah permintaan layanan eStatement dari Nasabah telah diterima dan disetujui oleh Bank, Bank akan mengirimkan pemberitahuan melalui email kepada Nasabah yang memuat “kata kunci” (“selanjutnya disebut “Password”) yang dihasilkan oleh sistem untuk membuka dan melihat email statement. Nasabah bertanggung jawab penuh dalam menjaga kerahasiaan Password dengan tidak memberikannya kepada pihak yang tidak berwenang. Bank tidak bertanggung jawab atas akibat yang disebabkan oleh kelalaian Nasabah dalam menjaga kerahasiaan Password. c) Dengan mendaftar untuk layanan eStatement berdasarkan ketentuan yang dikeluarkan oleh Bank, Nasabah menyatakan bahwa Nasabah berhak dan memiliki kapasitas untuk membuat perjanjian dan dengan ini menyatakan bahwa segala informasi dan/atau dokumen yang diberikan kepada Bank merupakan yang sesungguhnya, serta menyatakan dan menyetujui untuk mematuhi seluruh Syarat dan Ketentuan dalam perjanjian ini. d) Bank memiliki wewenang penuh dalam menyetujui atau menolak permintaan Nasabah atas layanan eStatement berdasarkan pertimbangan dan penilaian Bank e) Nasabah tidak dapat melakukan perubahan atas Password yang dihasilkan oleh sistem dan telah diberikan oleh Bank kepada Nasabah, oleh karena itu Nasabah bertanggung jawab penuh dalam menjaga kerahasiaan Password tersebut. f) Bank dapat melakukan pembatalan atas layanan eStatement sewaktu-waktu, dengan memberikan pemberitahuan secara tertulis kepada Nasabah. Atas pembatalan layanan eStatement yang dilakukan oleh Bank, Bank akan mengirimkan laporan tagihan bulanan melalui pos, atau dengan cara lain yang ditentukan oleh Bank. g) Untuk setiap permintaan layanan eStatement yang diterima oleh Bank, Bank akan melakukan verifikasi atas Nasabah, berdasarkan peraturan yang ditentukan oleh Bank. h) Dengan ini Nasabah menyetujui bahwa Bank memiliki wewenang untuk tidak mengirimkan laporan tagihan bulanan melalui pos kepada Nasabah yang telah mendaftar layanan eStatement dan telah disetujui oleh Bank 2. Pengiriman email statement a) Email statement akan dikirimkan oleh Bank melalui electronic mail ke alamat email yang telah diberikan oleh Nasabah pada periode bulanan b) Setelah menerima pemberitahuan dari Bank melalui email atas permintaan layanan eStatement, Nasabah dapat menggunakan Password untuk membuka dan melihat email statement. Email statement akan dikirimkan dalam format teks/grafik pdf, yang dienkripsi dengan Password. 3. Perawatan perangkat pendukung dan alamat email a) Nasabah wajib memastikan bahwa komputer maupun perangkat lain milik Nasabah yang dalam hal ini digunakan untuk mengakses layanan eStatement dirawat secara berkala serta bebas dari virus dan/atau piranti lunak apapun yang dapat menimbulkan gangguan terhadap system komputer milik Nasabah maupun sistem komputer milik Bank. b) Nasabah wajib memberitahukan secara tertulis kepada Bank alamat email milik Nasabah guna memungkinkan Bank untuk mengirimkan email statement melalui email kepada Nasabah. Nasabah bertanggung jawab untuk memastikan alamat email yang diberikan kepada Bank merupakan alamat email yang aktif dan berfungsi. c) Nasabah bertanggung jawab dalam memasang piranti lunak pendukung seperti Acrobat Reader pada komputer Nasabah, yang dibutuhkan untuk membuka dan melihat email statement. 4. Pelanggaran Jika Nasabah melakukan pelanggaran atas ketentuan-ketentuan dalam Syarat dan Ketentuan ini, Nasabah akan bertanggung jawab atas segala kerugian dan/atau kerusakan yang terjadi terhadap Bank, baik secara langsung maupun tidak langsung. 5. Biaya-Biaya Bank berhak untuk membebankan sejumlah biaya atas penyediaan layanan eStatement kepada Nasabah dengan memberitahukan terlebih dahulu kepada Nasabah jumlah dan cara pembayaran atas biaya tersebut, biaya mana akan ditentukan oleh Bank . 6. Pengakhiran Bank memiliki wewenang untuk mengakhiri layanan eStatement jika alamat email yang diberikan oleh Nasabah tidak benar atau jika ada permintaan secara tertulis dari Nasabah. Syarat dan Ketentuan ini akan berlaku selama 24 bulan (atau selama Nasabah masih menjadi pemegang Kartu Kredit yang diterbitkan oleh Bank). Sehubungan dengan pengakhiran ketentuan-ketentuan dalam Syarat dan Ketentuan, dengan ini Nasabah dan Bank mengenyampingkan ketentuan pasal 1266 dan 1267 Kitab Undang-undang Hukum Perdata. 7. Batasan Kewajiban dan Ganti Rugi a) Bank tidak bertanggung jawab atas kerugian maupun kerusakan yang diderita oleh Nasabah atau pihak ketiga dalam bentuk apapun, secara langsung maupun tidak langsung, yang meliputi namun tidak terbatas pada hal-hal sebagai berikut: (i) Bank melaksanakan instruksi yang telah diberikan oleh Nasabah. (ii) Nasabah tidak dapat mengakses layanan eStatement sebagai akibat dari kegiatan yang dilakukan oleh Bank atau selama proses perawatan sistem oleh Bank maupun oleh penyedia internet untuk layanan eStatement atau disebabkan oleh kegagalan atau kerusakan pada jaringan. b) Nasabah bertanggung jawab untuk memberikan ganti rugi kepada Bank atas segala kehilangan, kerusakan, termasuk biaya hukum, yang diderita oleh Bank yang disebabkan oleh penyediaan layanan eStatement oleh Bank kepada Nasabah atau karena Bank menjalankan wewenang yang tercantum dalam Syarat dan Ketentuan ini. 8. Perubahan Syarat dan Ketentuan Bank memiliki wewenang untuk merubah, menambahkan atau menghapus pasal-pasal dalam Syarat dan Ketentuan ini dengan memberikan pemberitahuan secara tertulis kepada Nasabah. Dalam hal perubahan yang dilakukan tidak dapat diterima oleh Nasabah, Nasabah berhak untuk mengakhiri penggunaan layanan eStatement dengan memberikan pemberitahuan secara tertulis kepada Bank Jika Nasabah tetap meneruskan layanan eStatement setelah adanya pemberitahuan atas perubahan tersebut, maka Nasabah dianggap telah menyetujui perubahan mengenai layanan eStatement tersebut. 9. Syarat dan Ketentuan lainnya a) Syarat dan Ketentuan yang tercantum diatas berlaku sebagai perjanjian yang telah disepakati antara Nasabah dan Bank dalam kaitannya dengan penggunaan Kartu Kredit yang dikeluarkan oleh Bank. b) Nasabah yang dimaksud dalam perjanjian adalah pemegang Kartu Kredit Utama dan tidak termasuk pemegang Kartu Kredit Tambahan. c) Nasabah menyetujui jika Bank juga mengirimkan brosur atau materi-materi promosi melalui electronic mail ke alamat email yang telah diberikan oleh Nasabah. 10. Pilihan Hukum Perjanjian ini tunduk dan dibuat berdasarkan hukum Negara Republik Indonesia. Jika terjadi permasalahan, Nasabah dan Bank sepakat untuk melakukan musyawarah. Nasabah dan Bank dalam hal ini memilih Kantor Panitera Pengadilan Negeri Jakarta Selatan sebagai domisili hukum tetapnya.
